Spalding landworker will lose job after driving ban




A landworker will lose his job after being banned from the roads.

Emil Tyfel had used his provisional licence to drive himself and a colleague will a full driving licence to Spalding to work in the fields.

But after being caught behind the wheel alone on February 26 he was handed six penalty points, which saw him incur a ban due to the totting up process.

The 45-year-old appealed to Boston magistrates to allow him to keep his licence when he appeared in court on Wednesday (March 12), arguing he would lose his job and be unable to send money home to his wife and children in Poland.

Prosecutor Lottie Tyler told the court that Tyfel, who already had six points on his licence, was seen driving his Audi A8 at Partney Road, Spilsby.

“A police check showed he was a provisional licence holder only, meaning his insurance was invalid,” she explained.

“The defendant wasn’t displaying L plates on his vehicle.”

Defending himself, Tyfel - who told the court he was driving on the day in question to buy an electric scooter - said: “I shouldn’t have taken the car but the situation forced me to do so.

“I’m unable to take my driving test because of work commitments.”

Swearing an oath on the Bible, Tyfel - who received a driving ban in 2015 for failing to provide a breath sample for analysis - asked magistrates to let him keep his licence due to the exceptional hardship he would face.

“I would have to change my job as the teams are fixed, there’s no-one to get work with” he said.

Tyfel, of Comer Close, Boston, said his family was reliant on money he sent home as his wife couldn’t work following an illness.

He pleaded guilty to driving otherwise in accordance with his licence and having no third party insurance.

The defendant was handed six penalty points and fined £120.

He must also pay £85 costs and a £48 victim surcharge.
